On January 6, 2012, the Department of Homeland Security published a "Notice of Intent" in the Federal Register which outlined a proposal to allow for stateside processing of I-601 waivers for unlawful presence. Allowing I-601 waivers for unlawful presence to be filed in the United States would reduce the amount of time that certain foreign nationals in need of the waiver would have to spend outside the United States and separated from their families. This seminar will provide an overview of the proposal and the rule-making process that must be followed, outline how the process likely will change and who may benefit from it, and provide guidance for attorneys wondering how best to advise their clients in light of the Notice of Intent.
