Crafting Particular Social Group Claims in Challenging Times

Presenting an asylum claim in this day and age is challenging enough, even more so if the claim involves a Particular Social Group (PSG). Effective advocacy requires careful legal research, thorough fact development, and creative strategies. The session will begin with a review of the foundational framework for PSG analysis, followed by a discussion of recent Board of Immigration Appeals and attorney general decisions that restrict PSG claims, particularly those based on family and gender. Presenters will also discuss the related nexus requirement and how to establish that your client's membership in a particular social group is "one central reason" for the persecution that they suffered. Presenters will help participants anticipate procedural challenges, including pretermissions of asylum claims based on failure to state a prima facie claim and the increasing use of third-country agreements (ACAs) by DHS, as well as strategies for preserving issues for appeal. Through case examples and interactive exercises, attendees will learn to think creatively and strategically about developing and presenting PSG claims and, despite these challenges, leave better prepared to advocate for their clients before asylum adjudicators.
