As DHS continues to escalate arrests and broaden its use of mandatory detention frameworks, habeas corpus remains one of the most powerful tools for securing clients’ release. We will review key recent developments, including changing government practices around final orders, OSUP revocations, third-country removal attempts, and the impact of other pending litigation. Presenters will cover strategic considerations for identifying viable habeas claims, responding to common government arguments, and framing detention challenges effectively.
This training is designed for practitioners with some familiarity with habeas practice who are looking to deepen their understanding of current trends and incorporate new approaches into their advocacy. While we will highlight developments in the Fifth and Ninth Circuit, the content will be relevant to practitioners across jurisdictions.
