You’ve mastered the elements of adjustment of status—but what happens after you file with USCIS? In today’s heightened enforcement climate, understanding discretion and risks isn’t optional; it’s essential. In this Part Two adjustment of status webinar, we’ll explore when and how discretion affects adjustment cases, how to evaluate risks both before filing and at the interview stage, and how to communicate these considerations effectively to clients. Practitioners will be better equipped to understand how discretion is exercised and how it shapes case strategy, how changing policies can impact adjustment, and strategize on how to handle interviews including when it may be best to stop an interview. Note that this is a follow up webinar to the April 21 webinar that discusses the basic legal requirements to adjust status, including the threshold requirement of having been "inspected and admitted or paroled" for adjustment of status under INA 245(a), or 245(i) for those who last entered without inspection.
