Removal Defense Webinar: Reopening After the Deadline

Many people have old, immigration judge-issued orders of removal that they want to reopen so that they can pursue immigration benefits. Yet the strict filing deadlines that apply to common statutory motions to reopen removal orders and motions to rescind and reopen in absentia removal orders make it likely that EOIR adjudicators will deny the motion as untimely. To overcome these strict deadlines and establish that the motion was timely filed, practitioners may be able to rely on the common law principle of equitable tolling. This webinar will cover the requirements for equitable tolling. Participants will then review a short, sample fact pattern to help participants understand, apply, and write about equitable tolling options. The speakers will also discuss the importance of constructing timelines in assessing equitable tolling arguments, the recent fee increases for motions to reopen, and tips on potential documentary evidence to include with the motion.
