The Trump administration has made unprecedented changes to immigration law through appellate decisions (by the attorney general and BIA), through regulations and agency guidance. This webinar will explore administrative law in the context of immigration policies. The panelists will discuss: substantive limits on retroactive application of new executive policies; arbitrary and capricious review; requirements that agencies acknowledge policy changes and account for reliance interests; and presumptions against retroactivity.
