Immigrants and State Courts: The New York Family Court Act & Federal Immigration Law, Policy and Enforcement

There is an intersection between state laws and the immigration status of many New Yorkers. State court decisions may impact immigrants both positively and negatively. The range and variety of issues, particularly in family court matters are broad and often unknown by judges and attorneys. These serious issues include immigrants who are survivors of violence or witnesses to crime may be able to legalize their immigration status by submitting crucial court documents in support of their applications for VAWA self-petitions or U visas. Likewise, young people who have been abused, neglected, or abandoned by at least one parent may be able to obtain Special Immigrant Juvenile Status upon findings by the family court judge. Conversely, some family court dispositions can render an immigrant deportable, trigger an immigration detainer or impair an immigrant’s ability to successfully obtain a green card or naturalization certificate. 

The panelists will:

  • Address the various issues that impact immigrants in NYS family courts
  • Introduce newly created online multi-formatted legal resource guides
  • Discuss the recent changes to federal law and the effect these changes have on immigrants in NYS courts
