At long last, USCIS has issued a final rule expanding the provisional waiver for the unlawful presence ground of inadmissibility. The new provisions, which go into effect on August 29, expand the categories of prospective immigrants eligible to seek this waiver, and also make some significant changes to provisional waiver procedures including (a) eliminating the “reason to believe” assessment regarding other grounds of inadmissibility and (b) allowing prospective immigrants to qualify even if already scheduled for an immigrant visa appointment.
