The Unauthorized Practice of Law: Responses from the Bar

In communities across America, unscrupulous individuals pose as attorneys qualified to assist immigrants obtain legal status. They hold themselves out as "notarios," taking advantage of the fact that in most Latin American countries, the term "notario" refers to a skilled attorney rather than a notary public. This fraud harms these vulnerable individuals, sometimes ruining any opportunity for the immigrant to correctly legalize their status. The impact reaches beyond the individual victims to the legal profession. As attorneys, how can we better respond to this unauthorized practice of law? What should lawyers do if they are aware of abuses in their communities? What ethical obligations restrict an attorney's ability to work with a "notario?" This is a complimentary CLE program.
