In this webinar, participants will learn when the one-year bar applies, how it is calculated, address burdens and standards of proof. The program will also cover exceptions to the one year bar based on changed or extraordinary circumstances and filing within a reasonable period of time, if an exception applies.
Presenters:
Dan Torres, ILRC Staff Attorney
Dan's work includes combating immigration provider fraud, conducting know your rights presentations, providing technical assistance to pro bono attorneys who are handling cases in the federal courts of appeals, and serving as the ILRC's Attorney of the Day. He is also the co-author of ILRC's publications, Asylum and Related Immigration Protections and Motions to Suppress. Before joining the ILRC, Dan represented clients as a staff attorney at the California Rural Legal Assistance Foundation in Sacramento, worked as a clinical instructor at the UC Davis School of Law Immigration Law Clinic, and served as a staff attorney for the United States Court of Appeals for the Ninth Circuit.

Scott's private practice emphasizes representation of asylum seekers, family-based applicants, immigrants with criminal records, and others in removal proceedings. He has mentored numerous pro bono attorneys representing asylum applicants through the Lawyers Committee for Civil Rights of San Francisco. He also has mentored law students at the California Asylum Representation Clinic at Boalt Hall. Scott has written and spoken about asylum law in various forums, including testimony about the Real ID Act before the San Francisco Human Rights Commission and commentary as a panelist discussing Refugee Roulette: Disparities in Asylum Adjudication at Stanford Law School. He is a graduate of King Hall at UC Davis and serves on the UC Davis Immigration Law Clinic Alumni Council.
