Although INA 245(i) expired on April 30, 2001, many people remain eligible for this unique benefit. Legacy INS and USCIS have issued multiple memoranda on 245(i) eligibility and the courts of appeals have also weighed in. This panel will provide an overview of the eligibility requirements for 245(i), review agency interpretations of the statute, and provide an update on BIA and federal court litigation.
