Learn how to erase convictions for immigrants, to avoid adverse immigration consequences. In the aftermath of People v. Kim, this seminar will discuss the various avenues of post-conviction relief that remain open, and outline several new procedural vehicles that still offer an opportunity to eliminate the immigration consequences of criminal convictions and sentences.
This Master Class assumes previous knowledge and experience with post-conviction relief, and will be at an advanced level. While it is primarily directed to attorneys who actively pursue post-conviction relief in criminal court, it is useful for immigration attorneys as well, since they need to inform criminal attorneys of the requirements of an effective vacatur and will want to evaluate the chances of success to determine whether to pursue relief in immigration or criminal court. Attendees will learn how to evaluate whether post-conviction relief is a realistic possibility without doing a lot of work. Although this course will emphasize California law, the first three hours of the seminar are relevant to any jurisdiction.
