Gang-based Asylum Claims After Matter of S-E-GDATE

In July, the Board of Immigration Appeals reopened the removal proceedings of three young Salvadorans whose gang-based asylum claim it had earlier rejected in the controversial precedent decision, Matter of S-E-G- 24 I&N Dec. 579 (BIA 2008). DHS joined a motion to reopen Matter of S-E-G- following litigation that reached the United States Supreme Court. The government asked that the Matter of S-E-G- respondents be allowed to pursue new asylum application pursuant to the William Wilberforce Trafficking Victims Protection Act (TVPRA).
This web CLE will review the most recent developments in the Matter of S-E-G- litigation and address the following issues:

• What is the status of litigation in the circuit courts challenging Matter of S-E-G- and its "social visibility" analysis?
