Isn't the petitioner the one who already has status as a LPR or USC? Isn't the beneficiary the one we have to worry about? Family-based immigration practitioners tend to focus their attention on the intending immigrant - the beneficiary - but thanks to IMBRA (International Marriage Brokers Act), the Adam Walsh Act, IBIS (Interagency Border Inspection System), and other issues, the petitioner may also be subject to restrictions on petitioning or vulnerable to enforcement.
