Cancellation of removal is currently the only potential remedy for the majority of undocumented immigrants in removal proceedings. Though the standard of proof for this remedy is difficult to meet, this seminar will teach you how to prepare the best cancellation of removal case possible for each of your clients.

This seminar will both analyze all the elements necessary to prove a case for cancellation of removal and provide practical pointers for preparing your case. Topics covered include:

  • Physical presence and the stop time rule
  • Good moral character, how it is defined and when the statutory period for establishing good moral character ends
  • Specific criminal bars and how to argue that they don't apply
  • Defining "exceptional and extremely unusual hardship," including an in-depth analysis of the leading cases on this issue
  • Identifying the different factors that have been recognized by the BIA and the federal courts as relevant to establishing exceptional and extremely unusual hardship
  • How to best work with clients to elicit important information that is relevant to establishing their hardship claims

As Cancellation of Removal topics are oftentimes difficult to digest, this unique seminar will provide succinct explanations, with an emphasis on how to elicit relevant information from clients. In addition, you will learn easy steps on how to prepare clients to testify and to analyze relevant hardship cases to support a hardship claim for any immigration remedy that requires some showing of hardship.
